Sample Contract
I This Middle Schoo Branch , Xinjiang Province,P.R. China(Engaging party)wishes to engage the service of Party B (Engaged Party) as an . The two parties,in a spirit of friendly cooperation,agree to sign this contract and pledge go fulfill conscientiously all the obligations stipulated in it.
II The period of service will be from the 1 day of sep ,20 05 to the 1 day of sep ,20 06 .
III The duties of Party B(see attached pages)
IV Party B's monthly salary will be 4000 RMB.
V Party A's obligations
1.Party A shall introduce to Party B the laws,decrees and relevant regulations enacted by the chinese government,the Party A's work system and regulations concerning administration of foreign expert.
2.Party A shall conduct direction,supervison and evaluation of Party B's work.
3.Party A shall provide Party B necessary working and living condition.
4. Party A shall provide co-workes.
5.Party A shall povide Party B's salary regularly by the month.
VI Party B's Obligations
1.Party B shall observe the laws,decrees and relevant regulations enact by the chinese government and shall not interfere in china's internal affairs.
2.Party B shall observe Party A’s work system and regulations concerning administration of forging experts and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.
3.Party B shall complete the tasks agreed on schedule and guarantee the quality of work.
4.Party B shall respect China’s religious policy, and shall not conduct religious activities incompatible with the status of an expert.
5.Party B shall respect the Chinese people’s moral standards and customs.
VII Revision,cancellation and termination of the contract.
1. Both parties should abide by the contract and should refrain from revising canceling, or terminating the contract without mutual consent.
2. The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.
3. Party A has the right to cancel the contract with a written notice to Party B under the following conditions:
（1）Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.
（2）According to the doctor’s diagnosis, Party B cannot resume normal work after a continued 30 day sick leave.
4.Party B has the right to cancel the contract with a written notice to Party A under the following conditions:
（1）Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.
（2）Party A has not paid Party B as scheduled.
VIII Breach Penalty
When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US $500 to2,000（or the equivalent in RMB）
If Party B asks to cancel the contract due to events beyond control. it should produce certifications by the department concerned, obtain Party A’s consent, and pay its own return expenses; if Party B cancels the contract without valid reason, it should pay its own return expenses and pay a breach penalty to Party A.
If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party B’s return expenses; if Party A cancels the contract without valid reason, it should pay Party B’s return expenses and pay a breach penalty to Party B.
IX The appendix of this contract is an inseparable part of the contract and has equal effect.
X This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 60 days prior to the expiration of the contract, and sign the new contract with mutual consent.
Party B shall bear all expenses incurred when staying on after the contract expires.after the contract expires.
XI Arbitration
This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 90 days prior to the expiration of the contract, and sign the new contract with mutual consent.
Party B shall bear all expenses incurred when staying on after the contract expires.
Ⅺ Arbitration
The two parties shall consult with each other and mediate any disputes which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Bureau of Foreign Experts and ask for a final arbitration.

APPENDIX OF CONTRACT
This middle school. Hereinafter referred to as Party A engages hereinafter to as Party B as . The two parties have reached an agreement on the following clauses:
1 Teaching Duties
1.1 Party B shall accept and complete the teaching and relevant work assigned by Party A conscientiously.
1.2 Party B shall prepare the teaching plan before each class. Party A has the right to check the plan or observe Party B’s teaching in the class.
1.3 Party A shall evaluate the teaching of Party B each term and award the excellent services provided by Party B.
1.4 There shall be a friendly cooperation between the two parties.
2 Working Time and Vacation
2.1 Party A’s normal working days shall be from Monday to Friday. Party B shall enjoy the Chinese Government’s holidays.
2.2 Party B shall complete the assigned 18 class periods per week （one class period is 45 minutes）. If necessary and possible Party B can apply for more class periods.
3 salary
3.1 Party A shall pay to Party B 4000 RMB per month. Party B shall pay the income tax per month according to the Taxation Laws of China.
3.2 Party B shall pay to Party B RMB for per extra class period. A deduction of RMB from monthly salary shall occur to any period shortened by Party B.
4 Travel Expense
4.1 Party B who first agrees to sing the contract for one year: If Party B from another city in china to urumqi ,Party A will cover the train tickets or direct air ticket(ecnomy class) from that city to urumqi. If Party B from his/her house of his/her home country to urumqi ,after Party B finished his/her three-month-work ,Party A will cover the train tickets or direct air ticket (ecnomy class)from that city to urumqi. At the expiration of the one-year contract,Party A shall provide Party B with a free and direct one-way international air ticket(economy class) to the nearestinternational airport from his house of his home country,the tickets are bought by Party A
4.2 Party B who fist agrees to sing the contract for half year,at the expiration of the half-year contract Party A shall provide Party B with a free and direct one-way international air ticket(economy class) to the nearestinternational airport from his house of his home country,the tickets are bought by Party A
4.3 Party A shall provide at least one time Party A paid domestic tour in Xinjiang for Party B per year.
5 working and living conditions
5.1Party A shall provide Party B with the necessary teaching facilities.
5.2 Party A shall provide Party B a fully furnished apartment to Party B with furniture, telephone, Internet access, TV set, air-conditioner, washing machine, fridge, microwave and kitchen facilities.
5.3 Party A shall provide certain amount of money for medical care according to the Chinese government’s regulations. Party B shall have his own medical insurance in Australia.
5.4 Party B shall pay all the utility fees in the apartment.
5.5 According to Party B’request ,Party A could provide chinese lessons and english speaking Chinese assistant.Party B shall pay Party A all of the above metioned.
5.6 Party B should takes care fo all facilities.If some thing is broken by Party B ,he/she must pay for repair cost.
6 sick leave and Absence
6.1 When Party B absent from his/her home twon, Party B provide a healthy certificate and certificate of no-crime record to Party A.
6.2 Party B shall undergo A complete medical examination in china that includes blood tests,x-ray,heart tests,etc and provide a healthy certificate and crime record certificate to part A.
6.3 With the medical certificate issued by the doctor, Party B shall have the right to ask for sick leave. If the leave is within 7 days, Party A shall pay Party B as usual. If it is over 7 days, Party B shall receive the sick allowance of RMB a day without the normal salary（1-day salary is 1/30 of the monthly salary）. If it is over a month, Party A shall have the right to terminate the contract.
6.4 Party B shall not be absent from his/her post during the term of contract. If indeed there are some reasons, Party B shall fulfill the procedures of asking for leave. Party A shall have the right to deduct the salary of the absent days of Party B,but Party shall finish the missing lessons.
6.5 If Party B is absent from his/her post without Party A’s consent, a deduction of 3-day salary shall be made for each day Party B is absent. Party A shall have the right to cancel the contract and take back the Foreign Expert Certificate and Residence Certificate if Party B is absent without Party A’s permission on the second time.
6.6 Due to internal work adjustment, This Middle scholl Branch shall assign another qualified instructor to replace Party B's position without
disruption of the normal academic management.
7 This appendix of the contract is an inseparable part of the contract This contract is made in chinese and english,with both versions having the equal effect.Party B comes up against other questions after entrance Xinjiang,the two parties consult with each other and reach a compromise to renew the contract.
