双方本着友好合作精神,按照公平、公正、公开的原则,充分体现权力对等、义务相等,在自愿签订聘用外国文教专家合同基础上自愿签订本合同附件并保证认真履行合同中约定的各项条款。
On the principle of equality, impartiality and publicity, the appendices of employment contract has been signed between foreign teachers and This Training Center for showing equal right and duty of both parties on the basis of voluntary signing the document. Both parties guarantee to follow the detailed terms of the document.

1、 直接报酬:货币工资
1、 Direct payment: Currency laborage
a. 每课时工资为人民币 55 元。工资以人民币支付,自到职之日起至学期结束之日止,按月发放,次月10日为付薪日(遇节假日顺延)。寒暑假为不带薪休假。合同期未满,未经聘方同意提前离校,聘方将追究受聘方违约责任,并由其承担一切经济损失。受聘方应按照中华人民共和国个人所得税法依法交纳个人所得税。
a .RMB 55 will be paid in RMB each class started from the first workday to the last work day within the period of the contract. The employee’s salary will be paid on the 10th day of the 2nd month of signing contract date. (One payment of salary will be delayed to next workday if meet holidays). There is no salary during the summer and winter holiday. If the employee leaves before the completion of the contract without the employer’s approval, the employee will take on the liabilities and all the financial loss for breach of contract. The employee must pay personal tax according to the income tax laws of PRC.
2、 间接报酬:聘方将保障受聘方在华生活的基本条件:
2、Indirect payment: The employer will guarantee the employee’s basic living condition in China:
a、住宿:聘方协助受聘方寻找适合的公寓,并提供相应的房屋补助。受聘方所产生煤气费、水电费、暖气费、电话费,上网费等自行负担。
a、 Living details: The employer will help the employee to find the suitable apartment and will pay to the employee accommodation allowance. Water, gas, electricity, heating, telephone, internet, utility bills the responsibility of Employee.
b、国际旅费:受聘方合同期满一学年(两个学期),工作期满,聘方将支付受聘方国际旅费6000元。工作期一学期国际旅费为2000元。若受聘方未能完全履行合同,聘方则有权利不提供此项补贴。
b、International traveling expenses: If the employment period is one year (2 terms) and the employee finish the work, the employer will pay 6000RMB to the employee for their international ticket. One term employment will pay 2000RMB for the international ticket. If the employee does not complete the contract then the employer has the right to refuse to pay this money.
四、受聘方的义务
IV、The duties of the employee
1、遵守中国的法律、法规及聘方有关规定和制度。不干预中国的内部现象,尊重中国的宗教政策,尊重中国人民的道德规范和风俗习惯,不传播宗教。不从事与专家不符的活动。
1、 The employee must obey Chinese laws, acts , rules and related regulations of the employer;The employee must not interfere with the internal affairs of China; the employee must respect Chinese religious policy, moral criteria and custom; the employee must not spread religion; participate in the activities which are not suitable for their own foreign experts status.
2、每周 25--30 课时教学任务,每课时45分钟,并在合理范围内给学生进行辅导。具体课时数及课程情况见课程表。
2. The employee’s workload is 25--30 teaching classes for each week (45 minutes per teaching class) and some additionally reasonable coaching. The practical class number and schedule will show on the school schedule.
3、每周参加1.5小时免费英语角及教研活动。
3、The employee should join in 1.5 hours’ teaching & research activities and the English Corner for 1.5 hours for each week for free.
4、每个月末,受聘方需要向聘方提供下个月的教学计划。
4、The employee shall submit the next month’s lesson plan at the end of every month.
5、受聘方不可以兼任与聘方无关的其他劳务,与聘方以外的任何单位所签订的任何合同均视为无效合约,不具有法律效应。
5、The employee cannot undertake any other part-time works , which is not related with the employer. It is invalid and illegal for the employee to sign any employment contract with any other employers.
6、受聘方不得将学校的任何信息透露给他人和机构。
6、The employee shall not reveal any information regarding her/his class to any other person or to other institutes.
7、合同期间内必须完成任务,保证工作质量。接受聘方的工作安排、业务指导、检查和评估。
7、During the period of the employment , the employment must complete work tasks with satisfied quality and follow the arrangements, operation instructions, checking and evaluation from the employer.
8、不得有不良嗜好。如:吸毒、酗酒、打架斗殴等,一旦发现立刻解聘。
8、The employee should not have bad habits such as illegal drug taking, fighting ,drunkenness, and etc. If any of these has been appeared, the employee will be dismissed immediately.
9、合同期内,如发生缺课的情况,受聘方须接受聘方的补课安排。
9、If there are missing classes during period of the employment, the employee need to follow the employer’s arrangements to make up all the missing classes.
10、经双方协商,受聘方有义务配合聘方的广告宣传(包括网站等)及参加社交活动。
10、The employee need to amenable to employer’s advertising and drumbeating of the company ( including the website and so on.) and attend employer’s social events.
11、如遇争议,双方应尽量考虑到文化和习惯的不同,相互协调,友好解决争议。
11、In the event that a dispute arises, both parties shall try to resolve it amicably with understanding of different culture and custom.
12、合同期间,因学校问题产生的缺课(如考试、社会活动、春秋游等),聘方将不支付此段时间受聘方的工资。
12、During the contract, any missing classes cause by school (such as examination, social events and so on.), employer will not pay the salary to employee in this period.
五、聘方的义务
V、The duties of the employer.
1、开学第一周,聘方统一安排有关部门负责人向受聘方介绍中国有关法律、法规和聘方有关工作制度以及有关外国专家的管理规定。
1、At the beginning week of the new semester, the employer will arrange the principals of departments concerned to make an introduction about the relevant Chinese laws, employer’s working regulations and related management rules of foreign experts to the employee.
2、如学校要求,配备合作共事人员(教师或学生课代表)。
2、The employer is responsible for providing teaching assistants if the school required. (Teachers or class representative)
3、次月10 日(遇节假日顺延)支付受聘方当月工资。
3、It is the employer’s responsibility to pay the monthly salary to the employee on the 10th of 2nd month (the payment of salary will be delayed to the next working day).
六、工作时间和休息休假
VI.、Working time and holidays
1、 受聘方的工作时间与聘方的教师相同。如遇公共假日需要倒休,受聘方需按照国家规定进行倒休。
1、 The employee will work with the same timetable as other teachers of the employer. If the workday needs to be change during the public holiday, the employee needs to follow the change by the law.
2、 受聘方享受下列节日休假:
中国的元旦、春节、国际劳动节、国庆节以及法律、法规规定的其他节假日。
2、 The employee will enjoy the following Chinese holidays: New Years, Chinese Spring Festival, Labors Day, National Day and other legal holidays.
3、 受聘方享受寒、暑假休假,具体放假时间由学校安排并于学期结束前通知受聘方。寒、暑假均为无薪休假。
3、The employee will enjoy the summer holiday and winter holiday. The timetable will arrange by the school and will let employee know before the semester ending. Winter and summer are on leave without pay
. 七、病假和事假
VII . Sick and private affairs’ leave
受聘方请病假,须凭聘方指定的医生证明。受聘方在一个合同期(一学年)内,累计病假不能超过十天,连续病假超过三天需出示医生证明。超过十天后,聘方有权解除聘用合同。病假期间,按课时数扣发工资。
受聘方请事假须经聘方同意,聘方将按日扣发工资,在合同期内,事假累计不得超过五天,连续事假不得超过三天,超过一天,将扣发双倍工资。未经聘方同意而擅离职守的,旷职一节,扣罚三节工资,情节严重的,聘方有权解除合同,并追究受聘方的违约责任,予以经济处罚。
If the employee need sick leave, he must show the doctor certificate, which has been issued by the appointed doctor of employer. The employee only has less than 10 days’ sick leave in total in one academic year (one contract period). If consecutive sick leave over than three days, employee needs to show the doctor certificate. If sick leave of the employee is more than10 days in total, the employer has the right to cancel the contract. During the sick leave, the salary will deduct by the number of missing classes.
If the employee asks for private affairs’ leave, the employer must approve it in advance. The employer will deduct the salary according to the amount of the leaving days. During the period of the contract the total private affairs’ leave must be less than five days. Consecutive private affairs’ leave must be less than three days. If the consecutive leave is one day longer than the permitted days, double salaries of one working day will be deducted. If the employee leaves their work without permission, the employer will deduct three classes salary from the employee for their one class absence. If the employee is seriously absent without approval, the employee has the right to terminate the contract.
八、合同试用期信誉保证金
VII、The credit deposit in the trial period of the contract
1、 受聘方的试用期为30天,在使用期内,聘方如发现受聘方健康状况或专业水平等不能胜任聘用合同规定的工作任务,有权解除合同。
1、 The trial employment period is 30 days. During this period, if the employer finds that the employee’s physical condition or major/specialty level is not qualified for the contract’s assignment, the employer has the right to terminate the contract.
2、 当事人一方不履行合同或者履行合同义务不符合约定条件,即违反合同时,应当向另一方支付1000—2000 美元(或相当数额的人民币)的违约金。
2、If either of the two parties fails to fulfill the contract or fails to follow the contract obligations about the stipulated terms, that is break the contract, it must pay a penalty of US$1,000 to $2,000 to the other parties(or the equivalent in RMB).
九、聘用合同附件各项条款的确定和变更均由当事人双方协商,并以书面形式做出约定,任何口头协议均视为无效。
IX、The terms in the employment contract and the employment contract appendices have been confirmed and changed by both parties through negotiation. They have been expressed in written form. Any oral agreement is ineffective.
十、本附件与标准聘用合同具有同等效力,是合同不可分割的一部分。
X、This employment contract appendices and the standard employment contract have the same effect and are indivisible.
十一、本合同附件以中英两种文字表述,各一式两分,聘方与受聘方各执一份。合同由中文书写,为了方便受聘方,合同在双方签署前被译成英文。若有对合同文本的不同理解,以中文为准。
XI、This contract appendices is written both in Chinese and English, and it has two copies. Each party’s takes one copy. The language of this contract is written in Chinese. For the convenience of the employee, this contract may be translated into English upon request and prior to the signing of these documents. In case of differences of opinion on the interpretation of the various versions, the Chinese version of this contract will prevail.
